Résumé: Le juge pénal porte une grande responsabilité dans toute société. Par conséquent, le juge devrait agir en toute objectivité comme la loi lui recommande en faisant d’elle-même et de sa conscience, les référents de son office. Si dans cette office il est appelé à interpréter la loi et à apprécier la peine au regard des faits, il devra se rappeler chaque fois du serment qu’il a prêté et de sa conscience qu’il gage par devant Dieu et les hommes pour avoir une légitimité. Malheureusement, la justice pénale est au Cameroun affectée d’un déficit de légitimité du fait de la corruption des juges. Peut-être serait-il nécessaire de prescrire une responsabilité pénale des juges pour des décisions souffrant d’un déficit d’objectivité, car tant que le juge sera conforté par son irresponsabilité, il aura tendance à succomber à la corruption pour appliquer subjectivement la loi pénale au grand dam des plus faibles.

Abstract: The criminal judge bears a great responsibility in every society. Therefore, the judge should act in all objectivity as the law recommends to him by making of himself and his conscience, the referents of his office. If in this office he is called upon to interpret the law and to assess the sentence in the light of facts, he will have to remember each time the oath he has taken and his conscience that he pledges before God and men to have a legitimacy. Unfortunately, criminal justice in Cameroon is affected by a deficit of serious legitimacy because of corruption. Maybe, it would be necessary to prescribe criminal liability of judges for decisions with a lack of objectivity, because as long as the judge is comforted by his irresponsibility, he will tend to succumb to corruption to subjectively apply the law criminal to the detriment of the weakest.
